Understanding your rights and responsibilities as a Hire Me user

These are the Terms of Use (“Terms”) under which all Job Seekers, Employers or other users (“You”) may use the Hire Me Sites and the Services (each as defined below). These Terms include the Hire Me Privacy Policy which is incorporated into these Terms by reference.

These Terms constitute a binding agreement between You and Hire Me Jamaica Ltd (“Hire Me”), and are deemed accepted by You each time that You use or access any Hire Me Site or Hire Me Services. If You do not accept the Terms stated here, do not use the Hire Me Sites and the Hire Me Services.

The Hire Me Sites are defined as any Web sites under Hire Me’s control, whether partial or otherwise (including, without limitation, hiremeja.com, and the Web site from which these terms of use were accessed from) and include the Hire Me Services.

The Hire Me Services are defined as the applications and services offered by Hire Me, including an on-line service to post and search human resource profiles or other interface that allows You to access such application (collectively, “Hire Me Services”). The Hire Me Sites also allow users (“Users”) to create individual profiles, which may include personal information (“Profiles”), and to make these Profiles, or aspects thereof, public. In addition, Hire Me may collect information about You from publicly-available websites and may use this information to create a Profile or append it to an existing Profile.

Hire Me may revise these Terms at any time by posting an updated version to this URL. You should visit this URL periodically to review the most current Terms because they are binding on You.

Users who violate these Terms may have their access and use of the Hire Me Sites suspended or terminated, at Hire Me’s discretion.

You must be 18 years of age or older to visit or use any Hire Me Site in any manner, and, if under the age of 18, must use any Hire Me Site under the supervision of a parent, legal guardian, or other responsible adult.

You may not use the Hire Me Content (as defined below) or Profiles to determine a consumer’s eligibility for: (a) credit or insurance for personal, family, or household purposes; (b) employment; or (c) a government license or benefit.

1. Use of Hire Me Content

Hire Me authorizes You, subject to these Terms, to access and use the Hire Me Sites and the Hire Me Content and to download and print a single copy of the content available on or from the Hire Me Sites solely for Your personal, non-commercial use. The contents of the Hire Me Sites, such as designs, text, graphics, images, video, information, logos, button icons, software, audio files and other Hire Me content (collectively, “Hire Me Content”), are protected under copyright, trademark and other laws. All Hire Me Content is the property of Hire Me or its licensors. The compilation (meaning the collection, arrangement and assembly) of all content on the Hire Me Sites is the exclusive property of Hire Me and is protected by copyright, trademark, and other laws. Unauthorized use of the Hire Me Content may violate these laws and/or applicable communications regulations and statutes, and is strictly prohibited. You must preserve all copyright, trademark, service mark and other proprietary notices contained in the original Hire Me Content on any authorized copy You make of the Hire Me Content.

Any code that Hire Me creates to generate or display any Hire Me Content or the pages making up any Hire Me Site is also protected by Hire Me’s copyright and You may not copy or adapt such code.

You agree not to sell or modify the Hire Me Content or reproduce, display, publicly perform, distribute, or otherwise use the Hire Me Content in any way for any public or commercial purpose, in connection with products or services that are not those of the Hire Me Sites, in any other manner that is likely to cause confusion among consumers, that disparages or discredits Hire Me or its licensors, that dilutes the strength of Hire Me’s or its licensor’s property, or that otherwise infringes Hire Me’s or its licensor’s intellectual property rights. You further agree to in no other way misuse Hire Me Content. The use of the Hire Me Content on any other application, web site or in a networked computer environment for any purpose is prohibited. Any code that Hire Me creates to generate or display any Hire Me Content or the pages making up any Application or Service is also protected by Hire Me’s copyright and you may not copy or adapt such code.

2. Use of the Hire Me Services

Hire Me databases and other features of the Hire Me Sites may be used only by individuals seeking employment and by employers seeking employees.

You are responsible for maintaining the confidentiality of Your account, Profile and passwords, as applicable. You may not share Your password or other account access information with any other party, temporarily or permanently, and You shall be responsible for all uses of Your Hire Me Site registrations and passwords, whether or not authorized by You. You agree to immediately notify Hire Me of any unauthorized use of Your account, Profile, or passwords.

    All Hire Me Users agree to not:
  • (a) transmit, post, distribute, store or destroy material, including without limitation Hire Me Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of Hire Me’s privacy policy;
  • (b) take any action that imposes an unreasonable or disproportionately large load on any Hire Me Site’s infrastructure;
  • (c) use any device to navigate or search any Hire Me Site other than the tools available on the Site, generally available third party web browsers, or other tools approved by Hire Me;
  • (d) use any data mining, robots or similar data gathering or extraction methods;
  • (e) violate or attempt to violate the security of any Hire Me Site including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
  • (f) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting;
  • (g) reverse engineer or decompile any parts of any Hire Me Site;
  • (h) aggregate, copy or duplicate in any manner any of the Hire Me Content or information available from any Hire Me Site, including expired job ads, other than as permitted by these Terms;
  • (i) frame or link to any Hire Me Content or information available from any Hire Me Site, unless permitted by these Terms;
  • (j) post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms, such as making or buying illegal weapons, violating someone’s privacy, providing or creating computer viruses or pirating media;
  • (k) post any resume or Profile on behalf of another party;
  • (l) defer any contact from an employer to any agent, agency, or other third party;
  • (m) set more than one copy of the same resume to public at any one time;
  • (n) share with a third party any login credentials to any Hire Me Site;
  • (o) access data not intended for You or logging into a server or account which You are not authorized to access;
  • (p) post or submit to any Hire Me Site any incomplete, false or inaccurate biographical information or information which is not Your own;
  • (q) post content that contains restricted or password-only access pages, or hidden pages or images;
  • (r) solicit passwords or personally identifiable information from other Users;
  • (s) delete or alter any material posted by any other person or entity;
  • (t) harass, incite harassment or advocate harassment of any group, company, or individual;
  • (u) send unsolicited mail or email, make unsolicited phone calls or send unsolicited texts, tweets or faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by You;
  • (v) attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any Hire Me Site, overloading, “flooding”, “spamming”, “mailbombing” or “crashing”;
  • (w) promote or endorse an illegal or unauthorized copy of another person’s copyrighted work, such by as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files; or
  • (x) use the Hire Me Services for any unlawful purpose or any illegal activity, or post or submit any content, resume, or job ad that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by Hire Me’s discretion.

Violations of system or network security may result in civil and/or criminal liability. Hire Me will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

3. Relationship with Hire Me

Hire Me merely makes the Site and Hire Me Services available to enable Job Seekers and Employers to find and transact directly with each other. Hire Me does not introduce Job Seekers to Employers, find Projects for Job Seekers, or find Job Seekers for Employers. Through the Site and Hire Me Services, Job Seekers may be notified of Employers that may be seeking the services they offer, and Employers may be notified of Job Seekers that may offer the services they seek; at all times, however, Users are responsible for evaluating and determining the suitability of any Project, Employer or Job Seeker on their own. If Users decide to enter into a Service Contract, the Service Contract is directly between the Users and Hire Me is not a party to that Service Contract.

You acknowledge, agree, and understand that Hire Me is not a party to the relationship or any dealings between Employer and Job Seeker. Without limitation, Users are solely responsible for: (a) ensuring the accuracy and legality of any User Content; (b) determining the suitability of other Users for a Service Contract (such as any interviews, vetting, background checks, or similar actions); (c) negotiating, agreeing to, and executing any terms or conditions of Service Contracts; (d) performing Job Seeker Services; or (e) paying for Job Seeker Services. You further acknowledge, agree, and understand that you are solely responsible for assessing whether to enter into a Service Contract with another User and for verifying any information about another User. Hire Me does not make any representations about or guarantee the truth or accuracy of any Job Seeker’s or Employer’s listings or other User Content on the Site; does not verify any feedback or information provided by Users about Job Seekers or Employers; and does not vet or otherwise perform background checks on Job Seekers or Employers. Hire Me makes no representations about and does not guarantee, and you agree not to hold Hire Me responsible for, the quality, safety, or legality of Job Seeker services; the qualifications, background, or identities of Users; the ability of Job Seekers to deliver Job Seeker services; the ability of Employers to pay for Job Seeker services; User Content and statements or posts made by Users; or the ability or willingness of an Employer or Job Seeker to actually complete a transaction.

You also acknowledge, agree, and understand that Job Seekers are solely responsible for determining, and have the sole right to determine, which Projects to accept; the time, place, manner, and means of providing any Job Seeker Services; the type of services they provide; and the price they charge for their services or how that pricing is determined or set. You further acknowledge, agree, and understand that: (i) you are not an employee of Hire Me, and you are not eligible for any of the rights or benefits of employment (ii) Hire Me will not have any liability or obligations, including under or related to Service Contracts and/or Job Seeker Services for any acts or omissions by you or other Users; (iii) Hire Me does not, in any way, supervise, direct, or control any Job Seeker or Job Seeker Services and does not dictate the performance, methods or process Job Seeker uses to perform services; (iv) Hire Me does not provide Job Seekers with training or any equipment, labor, tools, or materials related to any Service Contract; (vii) Hire Me does not provide the premises at which Job Seekers will perform the work.

4. Taxes and Benefits

Job Seeker acknowledges and agrees that Job Seeker is solely responsible (a) for all tax liability associated with payments received from Job Seeker’s Employers; (b) to obtain any liability, health, workers’ compensation, disability, unemployment, or other insurance needed, desired, or required by law, and that Job Seeker is not covered by or eligible for any such benefit from Hire Me; (c) for determining whether Job Seeker is required by applicable law to remit to the appropriate authorities any value added tax or any other taxes or similar charges applicable to the Job Seeker Fees and remitting any such taxes or charges to the appropriate authorities, as appropriate.

5. Contractual Relationships between Users

If an Employer and Job Seeker decide to enter into a Service Contract, the Service Contract is a contractual relationship directly between the Employer and Job Seeker. Employer and Job Seeker have complete discretion both with regard to whether to enter into a Service Contract with each other and with regard to the terms of any Service Contract. You acknowledge, agree, and understand that Hire Me is not a party to any Service Contract, that the formation of a Service Contract between Users will not, under any circumstance, create an employment or other service relationship between Hire Me and any User or a partnership or joint venture between Hire Me and any User.

With respect to any Service Contract, Employers and Job Seekers may enter into any written agreements that they deem appropriate (e.g., confidentiality agreements, invention assignment agreements, assignment of rights, etc.)

6. Hire Me Fees

Users agree to pay the Hire Me membership fees as prescribed in Hire Me’s fee schedule [Including link to fee schedule]

7. Warranty/Disclaimer

YOU AGREE NOT TO RELY ON THE SITE, THE Hire Me SERVICES, ANY INFORMATION ON THE SITE OR THE CONTINUATION OF THE SITE. THE SITE AND THE Hire Me SERVICES ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. Hire Me MAKES NO REPRESENTATIONS OR WARRANTIES WITH REGARD TO THE SITE, THE Hire Me SERVICES, WORK PRODUCT, USER CONTENT, OR ANY ACTIVITIES OR ITEMS RELATED TO THIS AGREEMENT OR THE TERMS OF SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Hire Me DISCLAIMS ALL EXPRESS AND IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

Hire Me is not liable, and you agree not to hold us responsible, for any damages or losses arising out of or in connection with the Terms of Service, including, but not limited to:

  • your use of or your inability to use our Site or Hire Me Services;
  • delays or disruptions in our Site or Hire Me Services;
  • viruses or other malicious software obtained by accessing, or linking to, our Site or Hire Me Services;
  • glitches, bugs, errors, or inaccuracies of any kind in our Site or Hire Me Services;
  • damage to your hardware device from the use of the Site or Hire Me Services;
  • the content, actions, or inactions of third parties’ use of the Site or Hire Me Services;
  • a suspension or other action taken with respect to your Account;
  • your reliance on the quality, accuracy, or reliability of, Profiles, ratings, recommendations, and feedback (including their content, order, and display) or metrics found on, used on, or made available through the Site; and
  • your need to modify practices, content, or behavior or your loss of or inability to do business, as a result of changes to the Terms of Service.

ADDITIONALLY, IN NO EVENT WILL HIRE ME, OUR AFFILIATES, OUR LICENSORS, OR OUR THIRD-PARTY SERVICE PROVIDERS BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR INDIRECT COSTS OR DAMAGES, INCLUDING, BUT NOT LIMITED TO, LITIGATION COSTS, INSTALLATION AND REMOVAL COSTS, OR LOSS OF DATA, PRODUCTION, PROFIT, OR BUSINESS OPPORTUNITIES. THE LIABILITY OF Hire Me, OUR AFFILIATES, OUR LICENSORS, AND OUR THIRD-PARTY SERVICE PROVIDERS TO ANY USER FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE OTHER TERMS OF SERVICE WILL NOT EXCEED JMD$5000.00. THESE LIMITATIONS WILL APPLY TO ANY LIABILITY, ARISING FROM ANY CAUSE OF ACTION WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE OTHER TERMS OF SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH COSTS OR DAMAGES AND EVEN IF THE LIMITED REMEDIES PROVIDED HEREIN FAIL OF THEIR ESSENTIAL PURPOSE.

9. Indemnity

You will indemnify, defend, and hold harmless Hire Me, our Affiliates, and our respective directors, officers, employees, representatives, and agents (each an “Indemnified Party”) for all Indemnified Claims (defined below) and Indemnified Liabilities (defined below) relating to or arising out of: (a) the use of the Site and the Hire Me Services by you or your agents (b) any Work Product or User Content developed, provided, or otherwise related to your use of the Hire Me Services; (c) any Service Contract entered into by you or your agents, including, but not limited to, the classification of a Job Seeker as an independent contractor; the classification of Hire Me as an employer or joint employer of Job Seeker; any employment-related claims, such as those relating to employment termination, employment discrimination, harassment, or retaliation; and any claims for unpaid wages or other compensation, overtime pay, sick leave, holiday or vacation pay, retirement benefits, worker’s compensation benefits, unemployment benefits, or any other employee benefits; (d) failure to comply with the Terms of Service by you or your agents; (e) failure to comply with applicable law by you or your agents; (f) negligence, willful misconduct, or fraud by you or your agents; and (g) defamation, libel, violation of privacy rights, unfair competition, or infringement of Intellectual Property Rights or allegations thereof to the extent caused by you or your agents. For purposes of this Section 9, your agents include any person who has apparent authority to access or use your account demonstrated by using your username and password.

“Indemnified Claim” means any and all claims, damages, liabilities, costs, losses, and expenses (including reasonable attorneys’ fees and all related costs and expenses) arising from or relating to any claim, suit, proceeding, demand, or action brought by you or a third party or other User against an Indemnified Party.

“Indemnified Liability” means any and all claims, damages, liabilities, costs, losses, and expenses (including reasonable attorneys’ fees and all related costs and expenses) arising from or relating to any claim, suit, proceeding, demand, or action brought by an Indemnified Party against you or a third party or other User.

10. Termination

Unless both you and Hire Me expressly agree otherwise in writing, either of us may terminate this Agreement in our sole discretion, at any time, without explanation, upon written notice to the other, which will result in the termination of the other Terms of Service as well, except as otherwise provided herein.
